Nokia vs. HTC in Germany and the UK #12
Nokia is asserting that HTC smartphones and tablet computers running Android versions 2.3 ability to decode VP8 videos. Specifically, Nokia is suing the Germany and UK branches which were presided by Judge Andreas Voss. Nokia based the infringement allegation on what the specifications of the Google-controlled VP8 standards say, which means that Nokia believes their patent has large claim over the VP8 market. Google is therefore participating in the lawsuit as a third party intervenor. A decision on the German case will be presented on May 3, of this year but will have no effect on the UK decision. If the decision goes in HTC and Google's favor, Nokia can still appeal on the grounds that they believe many of their other patents are infringed by VP8.

One interesting twist to this story is that the originators of the patents wasn't Google itself, but a company that they acquired. It'll be interesting to see how Google deals with this in Germany because I imagine that the same conflict will be replicated in other countries.
ReplyDeleteGreat article, Aviv. I don't know what will happen and it should be interesting to follow this with a close eye. Do you think it would be damaging or detrimental to Nokia if they lose the ruling and the appeal?
ReplyDelete@James, it's hard to know how exactly the VP8 technology is implemented in Nokia's products. That being said, considering how much time and money they are putting into this litigation, it seems as though their cost benefit analysis indicates that they need this victory.
